IN THE MATTER of the application of New Horizon Properties, LLC, for premises known as Block 56, Lot 1, on the Official Tax Map of the Township of Holmdel.

PLEASE TAKE NOTICE that the Zoning Board of Adjustment of the Township of Holmdel will hold a public hearing on Wednesday, November 18, 2020, at 7:00 p.m., via "Zoom" conferencing, to consider the application of the above-referenced applicant, for premises designated as Block 56, Lot 1, on the Official Tax Map of the Township of Holmdel, which premises are located at the intersection of South Laurel Avenue and Middle Road. Said premises are located in B-2 Neighborhood Business District. The property is 0.933 acres in size.
PLEASE TAKE FURTHER NOTICE that the applicant seeks the following relief:
Preliminary and Final Site Plan approval with use variance relief to develop the property as convenience store with a fuel service facility. The property is presently improved with a one-story masonry building/garage. The applicant proposes to demolish the existing structure on the property and construct a 3,000 square foot convenience store and fueling area consisting of six (6) fuel pumps.
(a) Use of the property as a convenience store, where same is not permitted in the B-2 Zone. Ordinance Section 30-143.3.
(b) Lot Area of 40,641 square feet, where 43,000 square feet is required for a service station use in the B-2 Zone. Ordinance Section 30-143.6 (existing condition).
(c) Lot Coverage of 61.9%, where 60% is permitted in the B-2 Zone. Ordinance Section 30-143.6.
(d) Frontage on Middle Road of 199 feet, where 200 feet is required in the B-2 Zone. Ordinance Section 30-143.6 (existing condition).
Waiver relief for constructing a permanent structure within a stream corridor buffer, where a 100-foot buffer is required and 35 feet is proposed. Ordinance Section 30-116.7.e. Waiver for a 50-foot buffer where 100 feet is required. Ordinance Section 30-116.7.e. Waiver for 40.1 foot residential buffer where 15 feet and 35 feet is required by Ordinance. Section 30-54C. Waiver for setback of 5 feet from Conservation Easement, where 10 feet is required by Ordinance. Section 30-58.d.13. Waiver for maximum light intensity of 25.3 foot candles beneath canopy and other areas of the site, where 1.0 foot candles are permitted by Ordinance. Section 30-69. The applicant reserves the right to request additional variance relief and/or waivers if same is determined to be necessary or appropriate by the Board or its staff prior to or during the public hearing.
This matter is presently scheduled to be heard by the Township of Holmdel Zoning Board of Adjustment at their regularly scheduled meeting of November 18, 2020, which meeting is scheduled to begin at 7:00 P.M., via "Zoom" conferencing.
